WebERF Terms of Use

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the scptac.org/WebERF website (the "Service") operated by the Southern California Pipe Trades Administrative Corporation ("SCPTAC", "us", "we", or "our").

Access to WebERF is restricted to authorized users including employers or authorized representatives of employers who have been assigned a user name and temporary password. Your access to and use of this Service is conditioned on your acceptance of and compliance with these Terms. If you disagree with any part of these terms then your access to this Service is prohibited. By accessing WebERF, you agree to comply with all the terms stated herein as well as any additional terms communicated to you through WebERF or SCPTAC.

Use of Site

Authorized users will be assigned an individual user name and temporary password. Upon initial login, you agree to change the temporary password and maintain confidentiality of that password to prevent unauthorized use of this Service. You must notify us immediately upon becoming aware of any unauthorized use of your account or if you believe the information you have submitted has not been accurately download or displayed by this Service. Unless we are so notified, there will be presumption that the information submitted in your or your company's name has been submitted by an authorized representative and is accurate and complete.

To inactive your account, please fill out an Inactive Status Request Form and email it to employerinfo@scptac.org. Upon receipt and approval of the Inactive Status Request Form, your access to this Service will be terminated.

WebERF is intended for the sole purpose of submitting monthly Employer Report Forms and payment to Southern California Pipe Trades Administrative Corporation. Some information submitted through this Service is confidential, including but not limited to Social Security Numbers. The copying, distribution, or emailing of confidential information contained in this website is strictly prohibited. Should you access confidential information of another user in error, you are strictly prohibited from dissemination, distribution or copying the confidential information. You are required to destroy any confidential information you obtain in error. Contact SCPTAC immediately should you view or access confidential information on this website not intended for you.

Terms of Service

By using this Service to submit monthly Employer Report Forms you certify the following: (1) that the information submitted is accurate; (2) that all hours reported are covered by a current District Council 16 Collective Bargaining Agreement, other applicable United Association Collective Bargaining Agreement or participation agreement with one or more Trust Funds administered by SCPTAC; (3) that this report is being submitted by the employer or authorized representative of the employer, and (4) that you will comply with any and all requests by SCPTAC for additional information determined necessary by SCPTAC to process your report or payment.

Your submission of accurate and timely information and payment is governed by the Employee Retirement Income Security Act (ERISA) and the Labor Management Relations Act (LMRA) and is enforceable under those laws. To the extent these laws do not apply to this Service, and these Terms of Use shall be governed and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law, and you hereby agree to the exclusive jurisdiction and venue of courts in Los Angeles and Los Angeles County, California in all disputes arising out of or relating to use of this website.

General Disclaimer

WebERF is intended to provide accurate information. Complete details, including current fringe benefit rates and employee classifications, are listed in the Collective Bargaining Agreement(s) to which the employer is bound. SCPTAC makes every effort to provide correct, up-to-date information; however, if there is any discrepancy between the information provided on WebERF and the Collective Bargaining Agreement(s) to which the employer is bound, the Collective Bargaining Agreement(s) will prevail.

By using WebERF, you acknowledge that the Service is offered for your convenience and you release SCPTAC and the Trust Funds it administers, from all liability resulting from such use, and you agree that in no event shall SCPTAC and the Trust Funds it administers, be liable for damages (including, but not limited to, lost profits, or damages, including incidental and consequential damages) resulting from the use or inability to use this website and the material contained herein or any malfunction of the website, including lost data.
